Welcome to ToMarkdown ("ToMarkdown," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website (https://tomarkdown.dev) and any services, tools, browser integrations, or application programming interfaces ("APIs") we offer (collectively, the "Services"). By accessing or using ToMarkdown, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Services.

1Definitions

"Services"

All features, functionalities, and offerings accessible via ToMarkdown, including—without limitation—online Markdown editors, converters, optimizers, user accounts, OAuth2 logins, and any APIs (now or in the future).

"Website"

The ToMarkdown website located at https://tomarkdown.dev and any subdomains or associated web properties.

"User," "you," or "your"

Any individual or entity that visits, registers for, or otherwise uses the Services.

"We," "us," or "our"

ToMarkdown and its owners/operators.

2Eligibility & Account Registration

2.1 Age Requirement

You must be at least 18 years old to register for an account or use any registered-only features of the Services. If you are under 18, you may still use our free, in-browser Markdown tools without registering an account, but you may not create an account, submit payment information, or access any paid features.

2.2 Account Creation

To access certain features—such as saving preferences, storing snippets, or using our API (when available)—you must create a ToMarkdown account. When registering:

  1. You agree to provide accurate, current, and complete information (including a valid email address and username).
  2. You agree to keep your account credentials (password or OAuth2 tokens) confidential and secure.
  3. You agree not to share your account credentials with any third party or allow others to use your account.
  4. You must notify us immediately if you suspect your account has been compromised or used without authorization.

2.3 OAuth2 Login

If you choose to sign in via a third-party OAuth2 provider (e.g., Google, GitHub), you authorize ToMarkdown to access the basic profile information (e.g., name, email, avatar) that you consent to share through that provider. You remain bound by the provider's terms of service with respect to any data obtained from that provider.

3User Conduct & Obligations

3.1 Compliance with Laws

You agree to use the Services in compliance with all applicable local, state, national, and international laws and regulations. You must not use ToMarkdown for any unlawful or prohibited activities.

3.2 Prohibited Actions

When using ToMarkdown, you agree that you will not:

  • Attempt to gain unauthorized access to any portion of the Services, accounts, computer systems, or networks connected to ToMarkdown.
  • Interfere with or disrupt the security or performance of the Services, including by uploading malicious code (e.g., viruses, trojans) or attempting denial-of-service attacks.
  • Use any automated means (such as spiders, scrapers, or robots) to access, monitor, or copy any content without our prior written permission.
  • Post or transmit any content that is unlawful, fraudulent, defamatory, obscene, harassing, hateful, or infringing on any third-party rights (including intellectual property).
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, underlying structure, ideas, or algorithms of the Services.

We reserve the right to investigate and prosecute violations of any of the above to the fullest extent of the law.

4Intellectual Property

4.1 Ownership

All content, design, features, and functionality of the Services (including but not limited to trademarks, logos, text, graphics, images, and software code) are the exclusive property of ToMarkdown or its licensors and are protected by copyright, trademark, and other intellectual property laws.

4.2 User-Generated Content

You retain ownership of any content you upload or create within ToMarkdown (such as saved snippets, profile avatars, or Markdown documents). By uploading or submitting any content to ToMarkdown, you grant ToMarkdown a non-exclusive, worldwide, royalty-free, irrevocable license to use, reproduce, distribute, modify, and display such content for the purpose of operating and improving the Services.

4.3 Feedback

If you provide feedback, suggestions, or ideas regarding the Services, you grant ToMarkdown a perpetual, worldwide, royalty-free license to use, incorporate, and modify that feedback in any manner without compensation to you.

5Subscription Plans, Payment & Refunds

5.1 Free Tools

ToMarkdown provides certain free, in-browser Markdown editing, conversion, and optimization tools accessible without registration. These free tools operate entirely client-side. (See Section 7 regarding privacy.)

5.2 Paid API & Subscription Plans

We may offer paid subscription plans (e.g., API access, advanced editing features, priority support) in the future. If you elect to subscribe:

  1. You agree to pay all fees specified at the time of purchase.
  2. Payments are processed through a third-party payment processor (e.g., Stripe or PayPal), and you agree to abide by that processor's terms.
  3. By providing payment information, you authorize us to charge recurring subscription fees (e.g., monthly or annual) until you cancel.

5.3 Refund Policy

  • Free Trial Periods: If a subscription plan includes a trial period, you may cancel within the trial window to avoid charges.
  • Refund Requests: Except where required by law, all payments for subscription plans are non-refundable once the trial period (if any) has ended and the paid features have been accessed.
  • Cancellation: You may cancel your subscription at any time via your account dashboard. Cancellation takes effect at the end of your current billing cycle; you will not receive a prorated refund for unused days.

6Privacy & Data Protection

Your use of ToMarkdown is also governed by our Privacy Policy, which is incorporated herein by reference. By using the Services, you consent to the collection and use of information as described in our Privacy Policy.

7Data Handling for Free Tools

  • All Markdown files you process with our free tools are handled entirely in your browser (client-side). We do not upload, store, or log your raw Markdown content, converted HTML, or any intermediate data on our servers.
  • While transient caching—such as your browser's local cache or our CDN's edge cache—may temporarily hold fragments of data, these caches are cleared automatically and not used for long-term storage.

8Disclaimers & Limitation of Liability

8.1 General Disclaimer

To the fullest extent permitted by law, the Services are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

8.2 No Guarantee of Accuracy

While we strive to keep all informational content accurate and up to date, ToMarkdown makes no representations or warranties that the Services will be error-free or that all content is completely accurate.

8.3 Limitation of Liability

In no event shall ToMarkdown, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages whatsoever (including, but not limited to, loss of profits, data, or business interruption) arising out of or related to your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages.

8.4 Maximum Aggregate Liability

Notwithstanding anything to the contrary in these Terms, ToMarkdown's total aggregate liability for all claims arising out of or relating to these Terms or the Services shall not exceed the lesser of (a) the amount you have actually paid to ToMarkdown in the six (6) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US $100).

8.5 Force Majeure

ToMarkdown shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including—but not limited to—natural disasters, acts of terrorism, war, governmental action, labor disputes, power failures, or Internet service disruptions.

9Modifications, Suspension & Termination

9.1 Changes to the Services

We reserve the right, at our sole discretion, to modify, suspend, or discontinue all or any part of the Services at any time, with or without notice. This includes adding new features, removing existing features, or changing pricing and subscription structures.

9.2 Changes to These Terms

We may revise these Terms periodically to reflect changes in our Services or legal requirements. When we make material changes, we will:

  1. Update the "Last Updated" date at the top of this document.
  2. Provide a notice on the Website (e.g., banner or pop-up) or send an email to registered users.

Your continued use of the Services after the effective date of the revised Terms constitutes acceptance of those changes.

9.3 Account Suspension & Termination

We may suspend or terminate your access to the Services (including your account) if you:

  • Violate these Terms or the Privacy Policy.
  • Engage in fraudulent, abusive, or illegal activities.
  • Infringe on the rights of others or pose a security risk.
  • Fail to pay any fees owed for paid Services.

Upon termination, your right to use the Services will immediately cease. Sections 4 (Intellectual Property), 5 (Subscriptions & Refunds), 8 (Disclaimers & Liability), 9.3 (Termination), 10 (Dispute Resolution), and 11 (Miscellaneous) will survive termination.

10Dispute Resolution

10.1 Informal Negotiation

In the event of any dispute or claim arising out of or relating to these Terms or the Services, you and ToMarkdown agree to first attempt to resolve the dispute through good-faith negotiations within thirty (30) days.

10.2 Governing Law & Jurisdiction

If we cannot resolve the dispute informally, you and ToMarkdown agree that:

  1. These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.
  2. The courts located in New Castle County, Delaware, shall have exclusive jurisdiction over all disputes arising out of or relating to these Terms. Each party hereby consents to personal jurisdiction in those courts.

10.3 Arbitration (Optional)

At our discretion, we may require that disputes be resolved by binding arbitration conducted in Wilmington, Delaware, in accordance with the rules of the American Arbitration Association. If arbitration is invoked, both parties waive their right to a jury trial.

11Miscellaneous

11.1 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11.2 Waiver

No waiver by ToMarkdown of any right under these Terms shall be deemed a waiver of any other right or of that right on any other occasion.

11.3 Entire Agreement

These Terms (together with the Privacy Policy) constitute the entire agreement between you and ToMarkdown regarding your use of the Services and supersede any prior or contemporaneous agreements, communications, or proposals—whether oral or written.

11.4 Third-Party Links & Services

The Services may contain links to third-party websites, plugins, or services not owned or controlled by ToMarkdown. We do not endorse, and are not responsible for, the content, privacy practices, or terms of any third party.

11.5 Assignment

You may not assign or delegate your rights or obligations under these Terms without our prior written consent. ToMarkdown may assign or delegate its rights and obligations at any time without restriction.
